What are the steps in a divorce?

Going through a divorce can feel overwhelming, but understanding the process can help ease the stress. In Ohio, the steps to divorce are designed to ensure fairness and clarity for both parties. Here’s a simple breakdown of what to expect.

File a complaint for divorce

The first step in any Ohio divorce is filing a complaint for divorce in your county’s court. This document outlines the reason for your divorce, such as incompatibility or irreconcilable differences. After filing, the court will serve your spouse with the paperwork, giving them the opportunity to respond.

Serve the divorce papers

After you file the divorce complaint, you must serve your spouse with the divorce papers. You can do this through a sheriff, a process server, or certified mail. Your spouse has 28 days to respond, usually.

Negotiating agreements

During the divorce, you and your spouse need to agree on key matters like property division, child custody, and support. If you and your spouse can’t agree, mediation or court hearings may be necessary. The court will try to help both parties reach a fair resolution but will step in if you cannot agree.

Finalizing the divorce

Once both parties make all agreements, or the court makes decisions for you, a final divorce hearing will take place. The judge will review the settlement or decisions made, and if everything is in order, the judge will finalize the divorce. You’ll receive a divorce decree, which legally ends the marriage.

Divorce can be an emotional and challenging process, but knowing the steps involved in Ohio can make it more manageable. By understanding the process, you can prepare yourself for what comes next.
