How to establish paternity in Ohio

On Behalf of | Oct 8, 2025 | Child Custody |

Establishing paternity is an important step for parents who want to ensure their child has legal rights and benefits. In Ohio, this process also helps both parents share responsibilities and build a strong foundation for their child’s future. Understanding how to establish paternity makes the process much smoother for everyone involved.

Why paternity matters

When parents legally establish paternity, a child gains access to financial support, inheritance rights, and benefits such as health insurance and Social Security. Paternity also clarifies parental rights and responsibilities, including custody and visitation. Without legal paternity, the father has no enforceable rights or obligations regarding the child.

Voluntary acknowledgment of paternity

Parents can establish paternity in Ohio through a Voluntary Acknowledgment of Paternity (VAP). Both parents sign this form at the hospital when the baby is born or later at a local Child Support Enforcement Agency (CSEA) or health department. After both parents sign and file the form, the law recognizes paternity. Either parent can cancel the acknowledgment within 60 days if doubts arise.

Court-ordered paternity testing

If parents disagree or feel uncertain about who the biological father is, a court can order genetic testing. The CSEA or a family court oversees this process. DNA samples from the mother, child, and alleged father confirm paternity with high accuracy. Once the results prove paternity, the court issues an order that legally establishes the father-child relationship.

How paternity affects custody and support

After parents establish paternity, the father can request custody or visitation rights, and the court can set child support obligations. Legal recognition of paternity ensures both parents contribute to the child’s upbringing. It also allows the child to benefit emotionally and financially from both parents.

Building a secure future for your child

Establishing paternity benefits everyone involved. Whether parents use voluntary acknowledgment or court action, taking this step strengthens family connections and protects the child’s rights.
